FOUR WOODLANDS:
MORAY: KEITH, ROTHES
A selection of commercial and amenity woodlands varying in size from 1 hectare to 42 hectares. Lot 1: Cullieshangan 3 miles west of Keith, Moray 1 hectare Offers over £10,000 Lot 2: Auchenroath 1 mile north of Rothes, Moray 42.16 hectares Offers over £80,000 Lot 3: Rheindown 2 miles north of Beauly, Ross-shire 1.7 hectares Offers over £35,000 Lot 4: Mullans 2 miles west of Tore, Ross-shire 12.62 hectares Offers over £70,000 Available for sale as a whole or in four Lots. GENERAL The various woodlands offered for sale are shown marked on the general location plans at the rear of these particulars and, in more detail, on the larger plans enclosed. The mix of commercial and amenity interests will appeal to those looking for both investment and other objectives, since several of the woodlands have the potential to restructure in order to favour interests beyond commercial timber production. The Lots are considered below, with specific notes relating to each one and then matters of general relevance covered together.
Directions From Inverness take the A96 to Keith, then in the town take the A95 towards Craigellachie. Travel along this road for 1/2 a mile before taking the first minor public road on the right, travel over the hump-back bridge crossing the railway line then turn left at the T junction at the top of the hill in front of the row of cottages. Follow this road for approximately 2 miles and the small wood is located on a sharp corner on the right opposite a small cottage. Description An attractive narrow strip of mixed conifer woodland planted in 1958, extending to approximately 1 Hectare (2.47 acres) with a burn running through and minor public road frontage. Access is taken directly off this minor road along the line marked D, E & F on the attached plan. Boundaries A-B & E-F are unmarked by fence hedge or dyke and in addition fence B-C is not erected on the legal boundary which lies inside the fence. The successful purchaser will be responsible for erecting a fence to a standard approved by the seller within three months of entry along the boundary A-B, which will thereafter be maintained mutually with the adjoining owner. There is a power line just outside the property on the line A-B. Note: There are several lock-up garages and a shed within the boundary of the disposal area near point E on the plan. These have been erected and occupied by the adjoining proprietor without formal authorisation and no binding agreement exists. The successful purchaser will be at liberty to make arrangements as they see fit with regard to these buildings and their occupiers and it should be noted that the sellers take no liability for this.
LOT 2: AUCHENROATH, 1 MILE NORTH OF ROTHES, MORAY 42.16 HECTARES (104.18 ACRES) Directions From Inverness take the A96 to Elgin, then in Elgin take the A941 signposted Rothes. At the first mini roundabout when entering Rothes turn left onto the B9015 towards Fochabers, travelling along this road a short distance, over the Broad Burn before taking the first minor public road on the left, signposted Rothes Mountain Bike Track. The wood is located a few hundred yards up the hill on the right opposite the distillery, with vehicular access provided by a gravel road, approximately 1/4 mile up the hill on the right just beyond Small Burn Farm, as shown by the blue route marked A-B-C-D on the sale plan. Description An attractive block of commercial woodland located to the north of Rothes with wonderful views across Speyside. The woodland was largely planted in the 1950’s with the stocking principally conifers, including Sitka spruce, Scots pine and Lodgepole pine. In addition, there are a considerable number of mixed broadleaves, predominantly Birch, around the woodland fringes, which add to the landscape interest. Although essentially planted as a commercial block of woodland, there are many factors contributing to its amenity and landscape interest, including opportunities to open up the views and restructure the woodland in order to enhance wildlife habitats or to create a network of footpaths. Boundaries D-E-F, H-J-K & L-M-N are unmarked by fence, hedge or dyke, and in addition fence line F-G-H is not entirely erected on the legal boundary which lies partly inside the fence. The woodland owners benefit from a non exclusive right of vehicular access for all forestry purposes over the route as shown in blue marked A-D on the sale plan.
1.7 HECTARES (2.2 ACRES) Directions From Inverness take the A862 to Beauly, in the town travel along the High Street before turning left at the Bank of Scotland onto Croyard Road. Travel up this road for about 1/2 mile crossing over the railway line, then at the crossroads turn right signposted Rheindown. Follow this road for approximately 1 mile up the hill before turning left onto the road sign posted Dunmore; the wood is located a further 50 yards on the left as you go up the hill. Access is taken off this minor public road along frontage marked A-F on the plan. Description This small block of amenity woodland located to the north of Beauly is a useful, well established plantation of Scots pine and Hybrid larch planted in 1953. It benefits from numerous viewpoints to the south across the surrounding countryside and east towards Inverness and beyond. The property is ideal for those wishing to enjoy woodland within a short distance form Inverness for their own recreational or environmental objectives, benefiting as it does from direct road frontage. Note: Fence A-B-C-D is not erected on the legal boundary which lies partly outside and partly inside the fence.
12.62 HECTARES (31.18 ACRES) Directions From Inverness take the A9 north towards Tore. At the Tore roundabout take the second exit on the left A836 towards Conon Bridge. Travel along this road for approximately 1 1/2 miles before taking the second minor public road on the left just before the Council roads depot. The woodland is located immediately on the right along this road. Description An attractive commercial block of woodland extending to approximately 12.62 hectares (31.18 acres) originally planted in the 1950s and predominantly stocked with Scots Pine. This block is ideally located, being only a short distance from Inverness and has the potential for a variety of recreational, sporting and commercial opportunities. Boundaries A-B, D-E & F-H are unmarked by fence, hedge or dyke. In addition, fence lines F-G-H & L-M are not erected on the legal boundary which lies partly inside the fence and Fence E-J-K & J-I are also not erected on the legal boundary which lies outwith the fence. Note: The successful purchaser will be responsible for the cost of maintaining boundary B-C-D-E-F along the public road. In addition they will be mutually responsible for maintaining boundaries F-H-I-J-K-L-M-NA with the adjoining owner. The adjoining proprietor is wholly liable for the cost of erecting and maintaining a fence to their own requirements along boundary A-B.
GENERAL NOTES APPLICABLE TO ALL LOTS FURTHER STOCKING DETAILS/PLANS Details of these for each lot are available to interested parties on request. DEVELOPMENT None of the land included in the sale is zoned for any development at present. If appropriate, purchasers should make their own enquiries with the local planning office: The Moray Council for Lots 1 and 2 (Council Offices, High Street, Elgin, IV30 1BX, Tel: 01343 543451) and the Highland Council for Lots 3 and 4 (Glenurquhart Road, Inverness, IV3 5NX, Tel: 01463 702000). PUBLIC ACCESS A number of the woodlands have existing footpaths used by the general public and interested parties should note that the Land Reform (Scotland) Act 2003 provides members of the general public with an opportunity to exercise non-motorised access rights over most land and inland water in Scotland provided it is done responsibly. MINERALS There are included in the sale of each Lot with the exception of coal. SPORTING The sporting rights for each lot are not presently let out and thus will be included within each sale. There are no significant historic sporting records for any of the woods. BOUNDARIES Subject to the specific comments relating to the various lots above, in general the owner of each of the woodlands will be wholly responsible for boundary fences where erected against a public road. Other boundary fences are mutual with the neighbouring owners, together with a right to hang rabbit/deer fence by either party at their own expense. In addition, if fences are required to protect plantations, these may be erected and maintained only for as long as considered desirable for forestry purposes.
STANDARD SECURITY The purchaser of each lot will be required to take out a standard security in respect of a further payment which would become due to the seller in the event of development of any part of the subjects of sale for a use other than forestry or agriculture. Such further sum to be equal to 50% of the difference between existing use value and value for development with this value to be assessed as at date of the grant of planning permission for the development. CROFTING None of the properties offered for sale are subject to crofting tenure. NATURE CONSERVATION AND ARCHAEOLOGY There are no statutory conservation, archaeology or landscape designations affecting any of the lots. ENTRY At a date to be mutually agreed for each of the Lots. DEPOSIT The purchaser will be required to pay a deposit of 10% of the purchase price within 10 days of conclusion of missives. No interest will be allowed on this deposit and if the payment is not made within the time limit, the seller reserves the right to cancel the sale contract. The balance of the purchase price will become payable upon the date of entry, whether or not psychical possession is actually taken by the purchaser. If this payment is not made by the due date, interest will be due from the due date until the full amount is paid. In the event of the balance not being paid within 6 weeks of the date of entry, then the seller will be entitled to cancel the sale contract and resell the subjects to any person. In such event, the purchaser will be liable for all loss, including all expenses, resulting from the resale. The seller will retain the deposit to offset such loss and expenses and will account to the purchaser for any balance remaining. DISCLOSURE It should be noted that since all these woodland sales are made on behalf of the Forestry Commission, the purchasers identity will be made public in the Forestry Disposals list and purchasers will be asked for their agreement to disclosure of the price paid.

The Seller will not be obliged to accept the highest or indeed any offer and has the right to accept an offer at any time or withdraw the property from the market. The Seller will not be liable for any costs incurred by interested parties. 8. Offerors, particularly those from England, should satisfy themselves, through their Scottish Lawyer, that they fully understand the implications of offering under Scottish Law. 9. THIRD PARTY RIGHTS AND SERVITUDES The subjects are sold together with and subject to all existing rights of way, servitudes, wayleaves and others whether contained in the Title Deeds or otherwise, and purchasers will be deemed to have satisfied themselves in all respects thereof. 10. CONDITIONS OF SALE A deposit of 10% of the purchase price shall be paid within seven days of completion of missives, which deposit will be non-returnable in the event of the purchaser failing to complete the purchase for reasons not attributable to the Seller or their Agents. The balance of 90% will become payable on entry. Interest will be payable on the balance at the date of entry until paid at a rate of 5% over the Bank of Scotland basic rate, notwithstanding consignation.
